Professional meeting with German colleagues

On November 18-21, Constitutional Court Judges Viktor Horodovenko, Viktor Kryvenko, Vasyl Lemak and Natalia Shaptala took part in the eighth professional meeting on constitutional law and constitutional procedural law issues.
The event was organised by the German Foundation for International Legal Cooperation, with the assistance of which the Ukrainian-German meetings on constitutional and legal issues have been held regularly and a fruitful exchange of scientific and methodological experience in cooperation with the Constitutional Court of Ukraine has been conducted.
The visit was a continuation of the traditional Ukrainian-German meetings on the exchange of scientific and methodological experience between the constitutional jurisdictions bodies of both states.
From the German side the event was attended by the retired Judge of the Federal Constitutional Court of Germany Reinhard Gaier and research fellow of Max Planck Institute for Comparative Public Law and International Law Matthias Hartwig.
Participants of the event were greeted by the General Director of the German Foundation for International Legal Cooperation Veronika Keller-Engels and the Director of the German Foundation for International Legal Cooperation Dr Stefan Hülshörster.
The program of the event provided for discussion of important issues related to the constitutional reform in Ukraine, and new powers of the Constitutional Court of Ukraine.
The agenda also addressed a number of relevant issues, in particular, limitation of social rights in times of crisis, the ratio of (social) fundamental rights, the violation of which can be challenged to the constitutional court, and social rights as the goals of the state.
The participants of the event also mentioned the issues of ensuring the implementation of the decisions of the Constitutional Court, in particular decisions on constitutional complaints and the issues of ensuring their implementation, as well as consideration by the Constitutional Court of the consequences of its decisions, the correlation between the jurisprudence of the European Court of Human Rights and that of the Constitutional Court.
Important topics for discussion were the consideration of cases by Constitutional Courts, withdrawal/ self-withdrawal of a Constitutional Court judge, the possibility of filling the gaps in the law with the decision of the Constitutional Court, evidence and the process of proof in the Constitutional Court proceedings.
The speeches and questions of Ukrainian delegation representatives aroused a great interest and a lively discussion with the German colleagues.
German colleagues, based on their own experience, expressed their views on the issues raised and expectations regarding the prospects for further constructive cooperation and the continuation of regular professional discussions in the same frame.
