Judges of the Constitutional Court of Ukraine took part in the sixth professional meetings on the constitutional and legal issues

On November 26–29, 2017, a delegation of the Constitutional Court of Ukraine composed of the Acting Chairman of the Constitutional Court of Ukraine Viktor Kryvenko, judges of the Constitutional Court of Ukraine Viktor Kolisnyk, Stanislav Shevchuk and Oleksandr Tupytskyi, research consultants of the judges of the Constitutional Court of Ukraine Nina Kucheruk and Viktoriia Havrylkina took part in the sixth professional meetings on the constitutional and legal issues which took place in Bonn, Germany. The event was organised with the assistance and support of the German Foundation for International Legal Cooperation (IRZ).

The visit was a continuation of the traditional Ukrainian-German meetings on the exchange of scientific and methodological experience between the bodies of constitutional jurisdiction of the two states. The programme of the event provided for discussion of important theoretical and practical aspects of modern constitutional legal proceedings.

The German side was represented by the former judges of the Federal Constitutional Court, Professor, Dr. Udo Steiner and Professor Dr. Reinhard Gaier, Researcher of Max Planck Institute for Comparative Public Law and Public International Law Matthias Hartwig and Director General of the German Foundation for International Legal Cooperation (IRZ) Veronika Keller-Engels. The latter delivered a welcoming speech to the participants of the event.

On the first day, the judges of the Constitutional Court of Ukraine told the German colleagues about the state of the constitutional reform in Ukraine and the implementation of new powers of the Constitutional Court of Ukraine. The judges presented a brief overview of the novels of the Law of Ukraine "On the Constitutional Court of Ukraine", dated July 13, 2017 and dwelt upon changes in the structure and activities of the Court.

Within the framework of the event, the participants held professional discussions about the forms of consideration of cases by the Federal Constitutional Court, the activities of the two senates in the Federal Constitutional Court, the distribution of cases between them and the coordination of legal positions, as well as the practice of processing constitutional complaints by the Federal Constitutional Court.

The participants also addressed the problems that arise in the case law of the Federal Constitutional Court in terms of balance of the fundamental rights and freedoms (for example, freedom of speech or freedom of the press and the protection of the private sphere, or the protection of personal data and public interest and freedom to receive information) and discussed the role of the constitutional court in the transition from an authoritarian to a democratic regime.

In conclusion, both sides expressed mutual hope about the prospects for further constructive cooperation and the continuation of regular professional dialogues in the same manner.
